with toys in kids meals. the san francisco land use and economic committee will consider an ordinance today that would set nutritional standards for meals that come with toys. if the meal has too many calories or salt or sugar, the restaurant will not be able to give a toy with it. the restaurant industry opposes the plan. governor schwarzenegger is in santa clara talking about the climate law at the convention center. it will be about noon today. he is expected to talk about what california needs to do to stay ahead in efforts to be green. >> it will be another hot day. we aare talking about it and we are live in castro valley and we are in our short sleeves today, christie. >> good morning. this is a perk of working at 5:00 in the morning. the weather is perfect. people are heading to the bart station wearing shorts and

when sending armed personnel to the airport. a north bay firefighter is in the hospital after being electrocuted child fighting a wildfire. he touched an energized power line. he is still in the hospital this morning. firefighters contained the fire yesterday, but it destroyed a building and a few vehicles. highway one was shut down on saturday when the fire first broke out. no waiting time for the trial to determine if william ayers abused his young patients. it's rescheduled for january 10th. the attorney asked for the delay because he might be suffering for alz himer or dementia. the judge declared a mistrial when the jurors could not reach a verdict. >> a budget deal could be announced in a few days.

lawmakers work through the weekend and think a deal will come early this week. california has not had a budget for nearly 90 days. the tentative deal is set to include suspensions and the selling off of more than $1 billion of state buildings. it reportedly relies on an upswing in federal funding. decision 2010. same-sex marriage advocates take aim at republican candidates. equality california is targeting meg whitman and hopeful steve cooley. they say whitman and cooley are turning them back and end up spending millions in taxpayer money. both said they would defend proposition 8 if elected. they want them to change their stated pledge to defend prop 8 in court. they are supporting jerry brown

for governor. . >> with more than a month to the november election, the gubernatorial debate between jerry brown and meg whitman will be critical. tens of thousands of voters are at stake. whitman and brown are in a dead heat with 18% of voters undecided. analysts say whitman has been making her case to voters for several months now. brown just started his campaign and may have a bigger challenge, especially with younger voters. >> if you were born in the 70s or 80s, you have no knowledge of jerry brown as governor of california. no actual memory probably. >> analysts say brown has to reintroduce himself to voters and whitman's challenge is to moderate her views since the republican primary is to win over moderate voters. they will host a debate october 12th. tom brocaw will moderate and air live on nbc bay area and on our

website and is it starts at 6:30 in the evening. join us a little bit earlier than that for the latest local news and we will have predebate coverage as well. >> more and more californians seem to be getting on board with proposition 19. about 49% of people say they are inclined to vote yes. the field poll found 42% planning to vote against it within the poll's margin of error. a big change when the proposition was trailing by four points. the equalization may change the way people vote on proposition 19. they said legalizing marijuana could generate $1.4 billion in new tax revenues. now they are not sure what legalizing pot will bring. officials say it will take months or years to implement the systems needed for collecting marijuana taxes if it passes. they leave it up to local governments to tax and regulate

marijuana. the field poll lifted proposition 23 until california's unemployment rate drops. opponents outnumber supporters by 11 points. 45% to 34. that's about the same as the results from the field poll in july. when it comes to plans to allow legislatures to pass budgets with a simple majority vote, californians are in favor. proposition 25 is leading 46% to 30. however that's way down from the 45% lead it had in july. >> giants are off today, but key decisions may be made from management about the lineup. san francisco is a half game up in the nl west and six games left in the season. the final strooe-game series is against the padres. a cy young winner, tim lincecum is not in the rotation to play right now. he is slated to play earlier this week against the diamondbacks. the manager could decide to give him an extra day of rest and

a broken levee has people fleeing and helps of people are in shelters and a state of emergency has been declared. 300 people live near the broken levee along the river and take a look at the water there. it's not clear how many have evacuate and a main road is flooded. there no reports of residents actually being stranded. floodwaters are expected to continue rising for the next several days. an important recall to tell you about. hyundai is recalling nearly 140,000 so nata sedans for potential steering problems. there may not be beings or injuries yet, but it comes after the national highway safety commission looked into potential problems last month. the steering column and connections may have been improperly assemble and cause

drivers to lose the ability to properly steer. >> a new report said nearly half of all guns at cross state lines and were used in crimes were sold in just 10 states. california is one. the report is put together by 500 may ors who make up the group mayors against illegal guns. it accounts for 21,000 guns connected to crimes in other states. the bureau of alcohol, tobacco and firearms explosives said 43,000 guns used in crimes were sold as i mentioned in just 10 states. california and arizona are the only western states on that list. president obama wants to know what's on your blackberry. we talked about that. the u.s. would be in the same line as countries like saudi arabia, india and the united arab emirates. >> they're put pressure on blackberry makers to see what was going on.

add the u.s. to the list, the "new york times" said president obama is pushing for wire tab laws that would give the u.s. access to blackberry encrypted e-mail and messages sent on social networks like facebook. the times said the obama administration will push to create a law forcing tech companies to have a backdoor into the messages through which the government can look with a warrant. mr. obama's position on government wire taps has been perplexing. candidate obama called for an immediate end to the wire taps which were illegal at the time. then senator obama wanted the taps stopped after congress made them legal, but the justice department has been defending the same tapping cases saying the government should not have to turn over the records to the people who were illegally spite upon. that has been disappointing to the civil rights people and

on scene and they have someone in custody after they failed to yield. they tried to pull someone over on the lower deck and it turned into a pursuit down into berkeley itself. that's all the flashing lights and the reason for all the commotion. they should have those next two lanes open and as soon as they arrive on scene, opposite the commute is the issue. the direction is 18 minutes off of the bridge towards the toll plaza. look how nicely things arefullying. lower deck is not disturbed after the pursuit took off the bridge and into the city. no major issues right now. a clear view, but jennifer will let you know about the heat. it's sticky today. back to you. >> stay away. revenge is sweet and a little funny. days after getting kicked off sesame street, katy perry is taking a jab back.

alto, today in the bay. >> thanks, bob. nobody is more interested in news than albert brown. he is the first man set to be executed in california in several years. brown's attorney filed an appeal after u.s. district judge jeremy fogle cleared the way for ex-cougs to resume. they changed the way lethal injections were administered. the death chamber has been rebuilt and they adopted new regulations. they have not been reviewed by a judge causing concern about the legality. brown is on death row for the rape and murder of a 15-year-old girl in riverside. he is scheduled to die wednesday. today a third suspect will number court in connection with the shooting of a police officer. francisco is a suspected gang member and charged with being an accessory in the attempted murder of officer todd young three weeks ago.

young was shot while he and another officer try to arrest andrew. he is still in the hospital after regaining consciousness a few days ago. >> a brazen attack in oakland. a mugging on the city streets and police are searching for the attackers. it happened yesterday along eighth avenue and international boulevard. the victim suffered a cut to the head and was taken to the hospital. police have not released a suspect description yet. >> get ready for a shake-up on the 49ers after yesterday's brutal loss to the chiefs. mike singletary is looking at changes and said it may not be just players, but staff as well. singletary was quick to add that the coordinator's job is safe. something has to happen. the niners are 0-3 on the season and lost yesterday, 31-10. now for the raiders, it was a tough night out. play by play ask they kept up with the cardinals. the final seconds of the game, the raiders marched down the

discuss education from the top down. that's exactly what this education nation and the two-day summit is all about. it's bringing about the leading educators and the policy makers and teachers from students from around the country, bringing them together into one setting where they can converse and be part of a think tank and go through as you mentioned what works in the classroom. what is not working in the classroom. certainly american students are behind on the world stage when they come here to rockefeller plaza and as they have over the course of the last few days. they will be able to take part in an interactive sort of learning plaza here. different stations around that are set up around this plaza and what they have are some curriculums on display and some schools that are work willing where teacher guess through the stations and say i might be able to take this back and this tool

back to the class and they're able to interact with the policy makers here that may be able to take the teachers's ideas back to where they go and could change policy down the road. we will see exactly how this all comes together over the next few days and certainly the town hall teacher session went very well. teachers are invigorated as well as the educateors. they are ready on a nationwide sort of effort as well as right down to the local classrooms to make sure they can implement change as quickly as possible. brent? >> thanks a lot, michelle. interesting. i spoke with matt lauer the other day about that and previewed the entire thing. he said they are going to be able to take questions too. some have been committed, but you can e-mail them in and get them going and find that on our site. they try to bring them to the president to ask him questions.

fall temperatures and it will feel like summer. how hot it will get? we will check in with jennifer hill. >> stunning revelations about higher education. the u.s. was once a world leader and a new study finds the number of young adults holding degrees is falling and america ranks behind several other countries. today in the bay's kristin dahlgren has a look at how the bay area fares. kristin? >> good morning, brent. we got an e-mail from the white house as the president announced a plan to recruit 10,000 engineering and math teachers over the next two years. clearly the white house really putting a focus on education. the president sits down with matt lauer this morning. it will be interesting to hear how he answers questions. he's the that set the goal of 60% of americans graduating from college by the year 2025. this new report from the lumina found as i for education said it

falls fall short. 37.9% of americans graduate from college. the foundation said the current rate will only be up to 46.6% of americans holding an advanced degree. the u.s. has to increase the number of degrees they are handing out by 278,000 each year, every year between 2025 to reach the goal. when you look at california, it's right around the national average. 38.6% of adults in california have at least a two-year degree. the bay area faring better. san francisco county at 61.2%. a rare, rare county that is over the 60% goal. down in santa clara it's 51 o 54.2% and the other bay area counties somewhere under that. a lot of them far short of the 60% goal that the president set by 2025. a lot of talk about education

a look at the seven-day forecast that continues. 98 degrees today and 93 for tomorrow. we are going to cool down. because today is a hot day, i want to remind people that you have to take it easy. with the inland areas up to above 100, it's hard to breathe. you bring in the bad air quality as well. especially if you have asthma or are sensitive, you don't top the do anything vigorous. we have cooled down. temperatures starting in the 50s and the 60s. 64 degrees in san mateo and 55 in senta rosa. 65 in san jose and 60 in livermore and 53 right now in gilmore and 63 in concord. talking about the bad air quality. the red on the map means it's unhealing we a lot of particulates in the atmosphere that makes it hard to breathe deeply. yesterday we did see a nice onshore flow that helped to keep air quality good. very stagnant air is in the
